Imagery published or distributed in violation of these conditions shall be subject to a minimum $3500/image liquidated damages charge, in addition to any applicable Copyright violation penalties and is protected by Electronic Communications Privacy Act, 18 U.S.C. Section 2510 et seq. In addition, Jason Hallmark may file for an immediate automatic entry by a court having jurisdiction of an order granting an injunction compelling the breaching Party to comply with that duty, obligation, or responsibility without a hearing, proof of monetary damage, irreparable injury or an inadequate remedy at law, or compliance with any other legal or procedural requirement to obtain injunctive relief; and reimbursement of all costs and expenses incurred by the non-breaching Party in enforcing those duties, obligations, and responsibilities of the breaching Party under this Agreement or otherwise defending or prosecuting any litigation arising out of the duties, obligations, and responsibilities of the breaching Party under this Agreement, including, but not limited to, premiums for bonds, fees for experts and investigators, and reasonable attorneys’ fees, costs, and expenses incurred before a lawsuit is filed and in trial, appellate, bankruptcy, and proceedings pertaining to the execution of judgments.
